New Delhi, Aug 23: The Delhi High Court today dismissed a petition which alleged that charging of fees from public sector undertakings by Attorney General Soli Sorabjee was in breach of Law Officers (Condition of Service) rules.When a division Bench comprising Chief Justice Arijit Passayat and Justice D K Jain said the petition was not in public interest, petitioner B L Wadhera requested for withdrawal of the petition. The Bench then dismissed the petitions as withdrawn.The petitioner had also stated that the Attorney General should not have given opinion to Hinduja National Power Corporation Ltd in respect of interpretation of the counter-guarantee given by the Central Government, notwithstanding the specific permission given by the then Law Minister who was also holding the Power portfolio.The Court observed that if a client wanted a top counsel to appear for them, it was open to the client to pay the agreed fees and there was no rule which prohibited the Attorney General or any other law officer from charging fees from public sector companies and undertakings.Referring to the Attorney's memo of fees annexed with the petition, the Bench asked Wadhera about the source from which he obtained them and said it was not in the interest of the lawyers' community that such petitions were brought to the Court.
