NEW DELHI, FEBRUARY 5: A Delhi court today reserved its order on an application of Dubai-based businessman Win Chadha seeking more time to appear before it in the Rs 64 crore Bofors payoff case while deferring execution of the non-bailable warrant (NBW) against him till February eight.

Special judge Ajit Bharihoke, who had issued fresh NBW against Chadha on February three, reserved his order for Tuesday after hearing his lawyer’s arguments and the CBI plea.

The NBW against the former Bofors agent is returnable by March 21, but the court has deferred its execution till disposal of his application filed soon after issuance of NBW.

Chadha’s counsel Ritu Singh Maan submitted that Chadha was not getting visa endorsement from UAE authorities on the passport issued by the Indian government to facilitate his travelling to India. He had not been actually handed over the passport, she said.

However, CBI counsel U S Prasad strongly opposed her contention saying the accused was making unreasonable demands and hejust wanted to delay the matter as he did not want to face trial in the case.

The fresh arrest warrant was issued against Chadha on Thursday after he failed to appear in the court despite an undertaking given by his counsel on an earlier date.

Earlier on January 20, the court had cancelled the NBW, issued against Chadha on December 14, as he did not have requisite travel documents to come to India.

While cancelling the NBW, Bharihoke had said, "On February three I expect him (chadha) to be here. If he (chadha) fails to comply with the court orders, warrant can always be issued against him."

Chadha’s Indian passport was impounded and revoked by theIndia consulate in dubai in 1990. Later his beliez passport was also revoked at the instance of cbi.

In his application, chadha said the government had onlyissued a passport for one year and "the resident uae visa on the basis of which the applicant is staying in uae can not be transferred from his impounded beliezian passport on a temporary travel documentsuch as an emergency certificate".

The consulate general of India at dubai had clarified tochadha on Sunday that the document issued to him was not a "temporary travel document but a regular short validity passport. Indian citizens possessing such regular validity passports are able to travel from uae to India".

She also said her client was too old and criticallyill and would require a 24-hour medical attendant. He might even need to travel back to uae for his ongoing treatment.

Chadha, who was accused by cbi of receiving a part of thekickbacks, in his application said he was "discriminated" against in being provided an ordinary passport and had written several letters to Union ministers L K advani and Jaswant Singh.
