PUNE, April 27: As per the order of the Additional District Consumer Dispute Redressal Forum Pravin Uttamrao Malwankar, resident of Laxminagar, Parvati, has been arrested and sent to Yerawada Central Jail for one-year simple imprisonment for contempt of the forum8217;s orders. He has also been fined Rs10,000.
The forum had ordered Vastushree Promoters amp; Builders, Rohini Vivek Joshi and Pravin Uttamrao Malwankar to pay Rs 37,470 to Balu Murlidhar Kapote for deficiency in construction service. Malwankar stated that he had neither preferred appeal nor paid the money.
Kapote had purchased a flat in Vijayshree Sankul complex, Chinchwad, developed and constructed by the opponents for Rs 2.54 lakh under a registered agreement. After taking possession he noticed that the flat was 73 square feet less in area and the terrace to the flat was 43 sq feet more in area. On applying the rate of the flat at Rs 265 and for terrace at Rs 125 sq feet he found that the total area worth Rs 21,270 was provided against the agreed area of 61 sq ft for flat and 10 sq ft for terrace.
He also maintained that the roof was leaking due to sub-standard water proofing requiring Rs 5,000 for rectification. He claimed Rs 10,000 as compensation for harassment, Rs 18,500 as dues besides Rs 21,270 in lieu of less area.
The forum found that the two partners of the firm had committed deficiency in housing construction service and arrived at a sum of Rs 37,450, ordering the three to jointly and severally pay the same to the complainant with interest.
While Joshi preferred to appeal to the State Commission against the forum8217;s order, Malwankar stated that he had neither preferred appeal nor heeded the order, leading to the strict action.
