Finding ruling Left Front chairman and CPI(M) Politburo member Biman Bose ‘‘guilty of contempt’’, a division bench of the Calcutta High Court today sentenced him to simple imprisonment for three days and fined him Rs 10,000.

If Bose fails to pay the fine, he will have to spend one more day in jail, the court ruled.

However, the court stayed the order for four weeks on a plea from Bose’s counsel, Bikas Ranjan Bhattacharya.

The CPI(M) has decided to move the Supreme Court against the order of the two-man bench of Justice A K Ganguly and Justice S P Talukdar. The decision was taken after Bose’s party top brass met at Alimuddin Street to discuss the development. A visibly agitated Bose told reporters: “I am neither shocked nor surprised at the order. But I did not expect such an order. I cannot comment about the ‘aspiration’ of the judge.”

The contempt of court application was filed by Kallol Guha Thakurta and Barindra Nath Ballav of All India Minority Forum before the High Court on October 13, 2003. They had moved court against Bose after he allegedly made some adverse remarks on October 4, 2003, against Justice Amitava Lala, who had banned rallies in the city from 8 am to 8 pm on working days.

Reacting to today’s ruling, Anil Biswas, CPI(M) state secretary, said: ‘‘Unless and until the case is granted in the Supreme Court and the final verdict comes in, I cannot comment on the order.’’
