The Ministry of Social Justice and Empowerment is in consultation with state government representatives to frame a legislation model for the care and protection of the elderly.
Minister for Social Justice and Empowerment Meira Kumar said at a two-day conference of state secretaries that the legislation proposal was being drafted with the aim of preventing the elderly from being marginalised. The proposed bill will cover various issues concerning care of the elderly, including housing, clothing and companionship requirements that either families or—in the case of those living below the poverty line—state governments are to provide.
Social Justice and Empowerment Secretary Sarita Prasad said sub-divisional level tribunals have been proposed to ensure conversion of the moral duty of offspring to look after their elderly parents, into a legal duty—another of the bill’s proposals. The bill will also provide for old age pension, homes in each district and specific health provisions for elderly.
Representatives of state governments participating in the conference supported the proposed legislation, drawn up along the lines of the Himachal Pradesh Parents’ Maintenance Legislation. Among the suggestions made, were that pension be given to those over the age of 60 and that the additional financial burden be shared by the Centre and states.
