CHANDIGARH, AUG 20: The Punjab and Haryana High Court has directed appropriate action against the president and executive officer of the Mohali Municipal Council, for their failure to perform their duties in accordance with law.
A division bench of the court comprising Justice Jawahar Lal Gupta and Justice N.C. Khichi, while disposing of a petition pertaining to delayed payment by the Council due to harassment, has directed the Secretary and Director, Local Bodies, Punjab, for taking appropriate action against the president and EO of the Council and further directed the Secretary, Local Government, to convey the final orders that may be passed to the registrar of the High Court, for being placed before this bench.
The bench, while directing such action to be taken within six months, has also imposed the costs of the case on the executive officer, which has to be borne by the EO personally. The judges had awarded costs to the tune of Rs 10,000 in the case to the petitioner, Rattan and Rattan Associates. However, the court held that the respondents shall be given opportunity before the final decision is taken.
The bench, while directing the Mohali Municipal Council, to make the claimed payment to the petitioner, along with interest at the rate of 18 per cent from June 30, 1997 till the actual date of payment.
The petitioner had earlier alleged that the Council was not making payment of Rs 69,863 to him for executing certain works in the Council in June, 1997, even after reminders. The petitioner had also alleged that the payment was not being made even when the cheques were ready and in spite of submitting affidavits and personal appearances to officials of the Council.
The petitioner had also alleged that he was harassed as he was instrumental in getting a vigilance raid in the Council premises for harassing the public and against officials who were seeking bribe for making the said payment.
While a vigilance case has already been registered, the High Court has now also directed the counsel for Punjab government to ensure that further action in pursuance to the case registered with the Vigilance department is taken expeditiously.
