Gujarat riots case: Supreme Court extends Teesta Setalvad’s interim bail till July 19

A special bench of Justices B R Gavai, A S Bopanna and Dipankar Datta, which took up the matter on Wednesday, issued notice to the Gujarat government on her plea. It also directed that the “interim order to continue till further orders”.

The Supreme Court on Wednesday extended the interim protection granted to activist Teesta Setalvad, accused of fabricating evidence linked to the 2002 Gujarat riots to implicate high government functionaries, as it posted her appeal challenging the Gujarat High Court order denying her bail for hearing on July 19.

A special bench of Justices B R Gavai, A S Bopanna and Dipankar Datta, which took up the matter on Wednesday, issued notice to the Gujarat government on her plea. It also directed that the “interim order to continue till further orders”.

By an interim order on July 1, the three-judge bench had after a special hearing at night, past 9.15 pm, granted interim protection to Setalvad and stayed the Gujarat High Court order passed earlier in the day, rejecting her plea for regular bail in the matter and asked her to surrender immediately.

On Wednesday, Additional Solicitor General S V Raju, who appeared for the state, sought time, saying he had to translate some of the documents and other records related to the matter.

Agreeing to the request, Justice Gavai said the court would post it on a date so that the hearing is not adjourned as it would then disturb three benches as the three judges are part of three different benches.

Senior advocate Kapil Sibal asked if it could be heard in August, but Justice Gavai said the bench would then tentatively start hearing petitions challenging the changes made to Article 370, which granted special status to Jammu and Kashmir.
