Kolkata doctor rape-murder case, August 25: A day after the West Bengal health department held separate talks in an attempt to restore normalcy at state-run hospitals, junior and senior doctors in the state, demanding secure work environments, continue to protest against the rape and murder of the trainee doctor at R G Kar Hospital. In view of this, the Kolkata Police has extended prohibitory orders near the hospital for an additional week, until August 31. Saturday’s meeting which is said to have “failed” was aimed at convincing the protesting doctors to resume work across state-run hospitals and colleges in West Bengal.

CBI takes over SIT probe into corruption at R G Kar Hospital: The Central Bureau of Investigation (CBI) is conducting raids at the premises of former principal of the state-run hospital Sandip Ghosh and 14 other places in the city in connection with the alleged financial irregularities at the hospital. This comes after the Calcutta High Court on Friday ordered the transfer from the Special Investigation Team (SIT) set up by the West Bengal government to probe the alleged corruption at the hospital since January 2021, a period that corresponds with Ghosh’s tenure.

What’s the status of the rape-murder case probe? A delegation of protesting doctors who visited the CBI office in Kolkata on Friday were told that the probe agency could not disclose any details of the case due to the court-monitored nature of the investigation. The accused Sanjay Roy was sent to 14-day judicial custody yesterday after he was produced in Sealdah Court in Kolkata. Meanwhile, the Calcutta High Court denied a request to block a planned protest march to the West Bengal state secretariat, Nabanna, on August 27, stating that the fundamental right to peaceful protest cannot be restricted.

HISTORY HEADLINE | 50 years ago, a nurse was attacked in a Mumbai hospital. What changed, what didn’t

The recent rape and murder of a junior doctor in Kolkata has led many to draw parallels with Aruna — on how little has changed for women, including the safety and security of women health workers in public hospitals. During a recent suo motu hearing on the Kolkata incident, Supreme Court Chief Justice D Y Chandrachud made a reference to the Aruna Shanbaug incident when he said, “Due to ingrained patriarchal biases, the relatives of patients are more likely to attack the women doctors and they are more susceptible to sexual violence too… the Aruna Shanbaug case is a case in point.”

Kolkata doctor rape-murder case Live Updates: BJP leader Suvendu Adhikari says Bengal govt attempting to divert attention from protest.

In a post on X, Leader of Opposition in the Bengal Assembly Suvendu Adhikari said: "Mamata Police is deploying a sinister 'toolkit' to redirect protestors away from marching towards Nabanna, where they seek justice for the RG Kar PGT woman doctor. The West Bengal Government is clearly shaken by the viral call for the 'Nabanna Abhijaan' on August 27." He continued, "The state government and its subservient administration are already under immense pressure following the massive public support for the 'Reclaim the Night' campaign, where women from all walks of life took to the streets to express their outrage. The rising momentum of the 'Nabanna Abhiyan,' led by a non-political student organisation, has evidently caused concern for Mamata Banerjee."

What is the context?

Chhatra Samaj, a student organisation, has called for the march to the secretariat on August 27 to demand justice for the woman doctor who was raped-murdered at a state-run hospital here on August 9,

The ruling TMC and certain civil society groups have alleged that the rally is being supported by saffron forces like the Akhil Bharatiya Vidyarthi Parishad (ABVP).

Express Opinion | Kolkata rape case: From Pakistan to India, the same misogyny

It is difficult to be anything but aghast and stunned at the grotesque facts of the rape and murder of the young trainee doctor at Kolkata’s R G Kar College and Hospital. What took place after she had been killed is equally blood-curdling: The condition of her body, the alleged attempt at a cover-up, the parents having to wait three hours to see their child, the hurried autopsy and cremation.

Since then, Indian doctors and Indian people, women in particular, have taken to protests and marches to ensure that some semblance of justice can be delivered to the victim’s family.

They have also brought attention to the deplorable conditions faced by female doctors and other medical staff who serve in extremely difficult conditions in under-resourced government hospitals and are denied any guarantee of safety. The inspiring Reclaim The Night movement is calling attention to how patriarchal systems of thought and society routinely deny women safe conditions in their workplaces.

Many have asked the pertinent and vexing question: Is it the absence of laws or the persistent patriarchal and misogynist mindset that is to blame here? (Read More)

Kolkata rape murder case: Oppn parties allege nexus between former RG Kar principal and TMC

Dr Sandip Ghosh, an orthopaedics professor, took charge as the principal of R G Kar hospital in mid-2021, after being promoted from his previous position at Calcutta National Medical College (CNMC).

Opposition parties in West Bengal have alleged a “nexus” between Ghosh, TMC leaders and government officials. TMC leader and former Rajya Sabha MP Santanu Sen had also sought that the CBI should investigate Ghosh.

Ghosh’s conduct came under the scanner again after the rape and murder of the R G Kar doctor on August 9. After junior doctors demanded that he should be removed from his post, he was transferred to the CNMC. After he faced student protests there too, the HC ordered him to go on leave.

He was later transferred to the health department as an officer on special duty. After taking over the investigation into the doctor’s rape-murder case, the CBI has questioned Ghosh over six days.

Kolkata doctor rape-murder case: Here’s what the Supreme Court said

The Supreme Court Thursday took a strong stand on the Kolkata doctor’s rape and murder case that it has been hearing after taking suo-motu cognisance of it, terming the Kolkata Police’s delay in registering the case as “extremely disturbing”.

During the course of the hearing, a Bench headed by Chief Justice D Y Chandrachud issued a slew of directions on the safety of doctors, norms for protests, rights of protesters as well as the West Bengal government.

Here’s what the Supreme Court said:

📌 If women cannot go to a place of work and be safe, then we are denying them the basic conditions of equality.

📌 SC asked the protesting doctors to first return to work, and assured them that no adverse action will be taken once they rejoin. “How will public health infrastructure run if doctors do not work,” the bench asked.

Kolkata rape and murder: When the law fails women

“I am not Nirbhaya. Neither was she… We are all scared of all men all the time,” read a post on X , following the ghastly rape and murder of a young doctor in Kolkata.

Ever since the infamous gang rape that rocked the country in December 2012, much has been done to strengthen the laws on rape. Where then lies the malaise? Why is the law failing to act as a sufficient deterrent? One answer is that laws on rape cannot be examined in isolation and be expected to regulate men’s mentality. Men’s brutalising of women continues to be rampant because of the laxity in laws surrounding other equally heinous crimes, which warrant immediate and equal attention as rape.

As per the statistics of 2022, annual dowry deaths in India stand at 6,516 — claiming one victim every 90 minutes. A dowry death is the unnatural death of a married woman who is murdered or commits suicide because of continuous cruelty by the husband and his family. What is more distressing than the large number of victims is the pitiably low conviction rate in such cases due to the shocking norm of the accused paying “blood money” to the victim’s family.
