A special court on Monday acquitted former BJP MLA Aakash Vijayvargiya, son of Madhya Pradesh Urban Development Minister Kailash Vijayvargiya, in a case where he and 10 others were accused of assaulting an Indore Municipal Corporation building inspector with a cricket bat in 2019.

According to the defence lawyer, the authenticity of a video that allegedly showed the assault could not be proved.

The accused were acquitted of various charges, including assault and criminal intimidation, by the special court set up for trial of criminal matters involving MPs and MLAs. The detailed order of the court is awaited.

“The prosecution could not prove the charges in court. Due to this, the court acquitted Vijayvargiya and nine others,” defence lawyer Udaypratap Singh Kushwah told reporters. “Another accused in the case was murdered (during the course of the trial),” he said.

The Indore Municipal Corporation official, Dhirendra Singh Bayas, was allegedly assaulted with a cricket bat on June 26, 2019. A case was registered against then-MLA Aakash and 10 others under IPC sections 353 (assault or criminal force to deter public servant from discharge of his duty), 294 (abusive language), 323 (assault), 506 (criminal intimidation), 147 (rioting) and 148 (rioting armed with deadly weapon).

The incident allegedly took place when Aakash was protesting against the demolition of a dilapidated house in the Ganji Compound area of Indore. A Congress government, led by Chief Minister Kamal Nath, was in power in the state at the time.

Aakash’s arrest came after the video that allegedly shows the assault went viral on social media. He was subsequently granted bail.
