Kushwaha plea against his prosecution rejected

Kushwaha had pleaded that the probe agency had not sought prior sanction for his prosecution under Section 197 of the Criminal Procedure Code.

The Allahabad High Court on Wednesday rejected former BSP minister Babu Singh Kushwaha’s plea in which he had challenged his prosecution by the CBI in the multi-crore National Rural Health Mission (NRHM) scam.

Kushwaha had pleaded that the probe agency had not sought prior sanction for his prosecution under Section 197 of the Criminal Procedure Code.

“The court has rejected the petition. However, we will have to wait for a detailed order to see the grounds on which the petition has been rejected,” said CBI’s counsel Anurag Khanna.

Kushwaha’s counsel Raj Kumar Ojha said only after receiving the detailed order, they will decide on approaching the Supreme Court.
