However,on perusal of a copy of the notification appointing Jain placed on record,the court found that the MLA “was appointed as Director and Chairman vide the same notification”.

The Bench pointed out to the relevant provisions which envisage that the hairman of the State Warehousing Corporation shall be appointed by the state government from amongst its directors. Earlier,in response to a query from the Bench,Jain’s counsel argued that the criminal cases registered against Jain under the Punjab Apartment and Property Regulation Act were politically motivated,which lead to an observation by the Bench. Confronting the state government’s counsel,the bench asked: “Can’t you find even one person with clean image for such an important post?”.
