IN ITS detailed order that allows Peter Mukerjea and Indrani Mukerjea part access to the statement of ‘secret’ prosecution witness number 32, a special CBI court has directed the central agency to delete one of the paragraphs before it is given to the accused. The court has also directed the CBI to ensure the safety and security of the witness.
Though the statement was part of the supplementary chargesheet filed against Peter Mukerjea, it was never disclosed. The identity of the witness too was never revealed.
“Presently there is no need to provide paragraph no 2 of the said statement (recorded by witness no. 32) to the defence. The reason behind that is the fact that the repute and status of a person named in the said paragraph will be at stake, if the said portion is delivered to the defence,” said special Judge HS Mahajan, who passed the order on Saturday.
The judge observed that the paragraph appeared irrelevant so far as the interest of Peter was concerned and was also not in public interest. Peter had approached the court last week seeking a copy of the statement since it was being relied upon by the CBI as evidence against him.

At the time of the filing of the supplementary chargesheet, the investigating officer had made an application before the metropolitan magistrate court stating that if the identity of the witness was disclosed to Peter, there was a possibility of the witness turning hostile under threat. The court had then ordered for the statement to be kept sealed. It was only on Saturday that the special CBI court opened the sealed envelope to peruse the statement to decide on Peter’s plea seeking access to it.
The court has allowed Peter and other accused the remaining three paragraphs. The CBI, however, has sought time to comply.
The hearing has been adjourned till July 20.
