(Representational Image)The Delhi High Court on Monday refused to entertain a PIL seeking implementation of the women’s reservation law to ensure 33% seats for women in the 2024 Lok Sabha elections.
A division bench of Acting Chief Justice Manmohan and Justice Mini Pushkarna said the issue is pending before the Supreme Court. In the Supreme Court, Congress leader Dr Jaya Thakur moved a writ petition on a similar issue, which is now listed for January 2024.
The bench said since the matter was pending before the SC, two courts cannot “simultaneously” look into the same issue.
“There is a provision in the Act, Article 334A. There is a process in the Act (that) it shall come into force after delimitation. We cannot go behind Article 334A; you will have to then pray for its quashing and make a case for it. Parliament has given a specific stipulation,” the bench said.
After some arguments, the petitioner’s counsel sought to withdraw the plea and was granted liberty to approach the top court.
