HND Hostel deal cancellation: ‘Proceedings moving at slow pace,’ say Jain ‘munis’, demand court decision

Jain “munis” on Tuesday demanded a decision by the civil court in two days in the Seth Hirachand Nemchand Digambar (HND) Jain Boarding and Temple case. Acharya Guptinandi Maharaj said a petition was filed in the civil court 10 days ago after the Charity Commissioner of Maharashtra approved the cancellation the property sale deed between the Seth Hirachand Nemchand Samarak Trust and Gokhale Landmarks LLP on October 30. Saying that the proceedings were moving at a slow pace, he said the “munis” would go on a protest if there was no decision in the case by Wednesday.

“The Charity Commissioner said the cancellation should be done as early as possible. But it has been delayed by 10 days now. This is a disrespect to the court, to the Maharashtra government, and the Charity Commissioner’s order. The builder and trustees have now filed an appeal in the civil court, and there is a saying ‘Jab miyan biwi raazi toh kya karega qazi’,” Guptinandi said.

“I would like to appeal to the judge that an immediate decision should be given in the matter and we should be given a final cancellation of the legal deed today or tomorrow. Otherwise, we saints have given our word and that has been described already. Our senior guru has said if this deal does not get cancelled soon he will protest in front of the CM’s house,” Guptinandi added.

Maharashtra Charity Commissioner Amogh S Kaloti, in an order on October 30, revoked the sale after the trust and Gokhale Construction both agreed to withdraw the deal. The order said, “(Both parties) shall take appropriate steps and measures for cancellation of sale deed and power of attorney dated 08-10-2025. Such steps and measures shall be taken at the earliest.”

Advocate Yogesh Pande, representing petitioner Sukaushal Jinturkar, told The Indian Express, “They have filed an application in a civil court on the basis of the Charity Commissioner’s order. So accordingly they have to file an application before the civil court for getting the decree of the cancellation. They will have to get a mutual consent declaration from the civil court.”

Pande added, “They filed the application last evening. Acharya is saying these things are proceeding at a very slow pace. Ideally, it was decided that everything would get closed within 15 days. But now only 4-5 days are remaining and if they are moving in such a delayed manner we don’t know what is in their mind. There is anxiety in the community.”

The sale of the HND Jain Boarding and Hostel by the trustees to Gokhale Construction resulted in a huge controversy. Pune MP Muralidhar Mohol came under fire for his links to the construction firm, who said he had parted ways with the firm 11 months ago. Opposition Congress leader Akshay Jain and ally Shiv Sena leader Ravindra Dhangekar launched attacks on Mohol. Finally, both the parties decided to cancel the deed.
