After Shiv Sena MLC Neelam Gorhe and Milind Narvekar — personal assistant to Sena executive president Uddhav Thackeray—- failed to turn up for voice sample tests at Bundgarden police station on February 26-27,the police on Monday moved an application in the court of judicial magistrate first class (JMFC) RL Wankhade,to cancel their bail.

“The application states that by refusing to appear for voice sample tests,Gorhe and Narvekar are not cooperating with the police investigation, which was a preliminary condition for bail,” said assistant public prosecutor Shilpa Mhatekar. The court is likely to take a decision on cancelling their bail on Tuesday.

Defence lawyer Shrikant Shivade has, meanwhile, submitted an application in the same court to stay the voice sample test by the police. The prosecution submitted its objection stating there was no provision to stay an order passed in a court after hearing the arguments of both sides,in the same court.

On February 24,the court had permitted the police to conduct voice tests on Gorhe and Narvekar. The police had booked both for criminal conspiracy and causing law and order problems in Pune after their cellphone conversation was tapped on December 28 last year. They had got bail on December 31.
