CBI special judge D R Mahajan on Tuesday granted anticipatory bail to former Army vice-chief Lt Gen Nobel Thamburaj (retd) who had moved court last month apprehending arrest after he was summoned for interrogation by the CBI in a cheating case.
The CBI special prosecutor Vivek Saxena had opposed the bail plea stating that the case related to fraud of Rs 46 crore,involving a 0.96 acre land at a bungalow in Pune cantonment. The court granted bail to Thamburaj.
In March,Thamburaj,through his lawyer Sudhir Shah,had obtained interim anticipatory bail against personal bond of Rs 30,000 with a condition that he will not leave the city.
On January 30,2009,the Army Headquarters in Delhi had registered a complaint against Thamburaj then the General Officer Commanding in-chief of the Southern Command in Pune and former defence estates officer Sewak Nayyar.
He was booked for criminal conspiracy,misconduct and cheating to the tune of Rs 46 crore by unduly favouring the construction firm Kalpataru builders in leasing a bungalow on defence land in Pune cantonment.
Thamburaj had denied the allegations stating that no defence land was transferred to any builder during his tenure in Southern Command and that the said building was constructed before he had taken charge.
