BJP’s Alinagar MLA Mishri Lal Yadav and his associate have been sentenced to three-month imprisonment each for voluntarily causing hurt to one Umesh Mishra in January 2019.
Special Judge cum Additional Chief Judicial Magistrate Karuna Nidhi Prasad Arya of the special MP/MLA court in Darbhanga also imposed a fine of Rs 500 on Mishri Lal Yadav and Suresh Yadav each after finding them guilty under IPC Section 323 (voluntarily causing hurt).
After the sentencing, both Mishri Lal and Suresh were ordered to be released on bond, their lawyer Kauser Imam Hashmi said, and added that “they would appeal the decision in a higher court”. The court took cognizance of the case on April 17, 2020. During the trial, the prosecution presented testimonies from eight witnesses.
In the FIR lodged with the Raiyam police station, complainant Umesh Mishra, a resident of Samaila village, had alleged that on January 30, 2019 he was confronted by Mishri Lal, Suresh, and several armed individuals near Kadam Chowk in the Gosai Tola area.
According to his statement to the police, when Umesh protested against the verbal abuse, “Mishri Lal attacked him with a sickle, causing severe injury to his head.” The FIR also mentioned that Dheeraj Yadav, Mishri Lal’s son, “struck Mishra with the butt of a rifle, leading to his fall, following which, Suresh and another individual, Dharmendra, assaulted him with sticks and rods, resulting in multiple injuries.”
As per the FIR, “Dheeraj stole his watch, and Suresh took ₹2,300 from his pocket.” “When a few acquaintances of Mishra attempted to intervene, they were also threatened and assaulted by Mishri Lal and his associates,” the complaint stated, adding that the assaulters also “threatened him with his life to not file a case with the police.”
The police submitted a chargesheet on October 12, 2019. After the initial investigation, Dheeraj and Dharmendra’s names were removed from the chargesheet, leaving only Mishri Lal and Suresh as the accused, their lawyer said.
Mishri Lal, 68, won the Alinagar seat in 2020 on Vikassheel Insaan Party ticket, and joined BJP in 2022 along with three other MLAs. Yadav has also served as a member of the Bihar Legislative Council from July 2003 to July 2009.
