Two cases of dishonoured cheques worth Rs 5.28 cr settled in Lok Adalat

Two cases related to dishonour of cheques worth Rs. 1. 42 crore and Rs. 3.86 crore were settled in National Lok Adalat held on Saturday

The two cases under the Negotiable Instrument Act were filed in 2020 by Beacon Trusteeship at Metropolitan Magistrate Court in Bandra against Aditri Estate Developers Pvt. Ltd for dishonoured cheques in a commercial transaction.

On Saturday, the cases were settled before a panel headed by Magistrate Mahesh Saraf and consisting of advocate Sanjay Ashtekar.

The parties had settled the disputes earlier before the Bombay High Court in a commercial arbitration litigation and in light of the proceedings, the parties amicably settled the dispute before the ‘Lok Nyayalay’ held on Saturday.

As per the panel, these cases were unique since they featured an alternate dispute resolution mechanism as they were settled in arbitration proceedings and Lok Adalat.

“The parties were able to settle their dispute speedily by the use of an alternate dispute mechanism, instead of fighting the same for years together,” the panel noted. The panel also ordered the registry to refund the court fees paid by the complainant.
