Resident doctors’ protest- JJ dean to be made party in matter: Bombay HC

THE Bombay High Court Monday said the dean of JJ Hospital Dr TP Lahane should be made party in a matter relating to doctors’ strike against the dean which was withdrawn last Saturday after the HC asked Maharashtra Association of Resident Doctors (MARD) to do so.
While withdrawing the strike, MARD had sought to reconstitute a grievance redressal committee after they complained that the existing committee included the dean against whom the doctors had grievances. The court had agreed to the demand.

While hearing the matter on Monday, the court, however, pointed out, “How can you constitute a committee without hearing the person (Dr Lahane) against whom the allegations have been made? This will lead to further litigation where the other party will come to court demanding a fair hearing,” said the HC. The court has now asked he be made party in the matter.
The court questioned if the committee had the scope to enquire into allegations against the dean. Acting Advocate General Rohit Deo said the present committee of five members could look into such allegations, besides other grievances raised by the doctors.
The committee, which is to be re-constituted, now proposes to include seven members which will include a retired judge, additional secretary medical education, director medical education, state government, and director medical education, Brihanmumbai Municipal Corporation.
The counsel appearing for MARD said the doctors were not properly represented in the last hearing on Saturday, while pointing to the decision on the suggested names of members who would be part of the reconstituted committee. The court said they were not going to go into the correctness of the order. “We will not tolerate this. You can’t dictate terms,” said the court.
The names of former Chief Justice Mohit Shah or former Justice DK Deshmukh had been suggested for heading the cell. The court has asked the registry to check their availability.
