A metropolitan magistrate’s court Thursday rejected an application by the LT Marg police seeking to produce Nooriya Haveliwala before the trial court and seek fresh custody under the Narcotic Drugs and Psychotropic Substances Act.

A metropolitan magistrate’s court Thursday rejected an application by the LT Marg police seeking to produce Nooriya Haveliwala before the trial court and seek fresh custody under the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

The court rejected the application on grounds of health. Haveliwala has been admitted to JJ Hospital with a stomach ailment.

The forensic report on Haveliwala’s samples allegedly found not only more alcohol than permissible but also drugs. Besides facing charges of causing two deaths with negligent driving, she has now been booked under the NDPS Act.

“We have booked her under sections of the NDPS Act and sought her custody to investigate further, but we were informed that custody couldn’t be granted until she is discharged,” confirmed a senior police official.

Defence advocate Renuka Laxmeshwar said,“Although they claimed possible traces of drugs in her blood,no forensic report was produced in court on Thursday. The court has rejected her further police custody until she recovers and is discharged.”
