Ex-serviceman’s death after scuffle: Court acquits three of family as witnesses turn hostile

Injuries were caused to both sides and separate complaints were filed with the police by both the families. Subhash, however, succumbed to the injuries. Subsequently, a case of murder was filed against three members of the Shirke family, Kishor, Kunal, Sunil.

During the trial, Subhash’s wife, Sushma told the court that her husband was working in the military of the US Army as a lieutenant and had come to Mumbai in 2016. Sushma said that on the day of the incident she received a text message about some incident and she rushed to find her husband having sustained injuries on his stomach and chest, after which she rushed him to the hospital. She, however, denied that she had seen the accused from the Shirke family attack her husband. Her daughter, too, similarly deposed about not knowing how her father sustained the injuries. Four other building residents also turned hostile.

The court said that with important witnesses not supporting the prosecution, there was nothing on record to prove the case against the accused, and hence it acquitted them of all charges.
