A special court has rejected the bail application of Mohammed Zoheb Khan, who was booked in connection with an ISIS conspiracy case by the National Investigation Agency (NIA).
Khan, an IT professional, was arrested in 2024 and sought bail claiming that there is no evidence of him having committed any terrorist activity. The NIA opposed his bail plea claiming that he along with the co-accused hatched a conspiracy to further activities of terrorist organisation, ISIS.
Special judge C S Baviskar said there was prima facie evidence that Khan had been involved in planning of terrorist activities. The court said that there was electronic evidence pointing towards his involvement.
“From the telegram which is recovered from the mobile of this applicant/accused Zoheb, it reveals that, wanted accused No. 2 Abu had directed this applicant/accused Zoheb to arrange for Improvised Explosive Devices (IED)/ bombs, which this applicant/accused Zoheb has referred as ‘saman’ in his communication with wanted accused to carry out terrorist attacks in India at the targeted spots,” the court said. It added that the allegations were that the accused were intending to implementing shariah law.
“Ironically enough to achieve such goals of implementing social system of hundreds and thousands years old, the accused have been using all the modern tools and technics evolved by modern science! And there they are trapped. Because, electronic evidence forgets nothing and forgives none. It can be traced out even though attempted to be wiped out. It can be certainly traced out and also can be linked to its creator. This is done by the investigating agency in this case. The only thing is that, it has to be proved during trial,” the court said.
Special judge Baviskar also referred to teachings of Islam stating that verses of the Quran and Hadith, and those of Prophet Mohammed, mention that loving one’s country is part of the faith.
“This unerringly highlights that, patriotism and loyalty to one’s own homeland, are not separate from, but rather, integral aspects of religious beliefs of true Muslim. Love and loyalty towards one’s own country is in no way in conflict with commitment to Allah and Quran. A true Muslim fulfils his duties to both,” the judge said, stating that the allegations against the accused show that they had not followed these teachings.
