Lame excuses, says court, rejecting plea by police to file chargesheets after delay

STATING THAT the delay in filing chargesheet was not explained properly, a magistrate court in two separate cases against political leaders, refused to allow pleas by the police, seeking permission to file chargesheets.
The first case was of a protest by Maharashtra Speaker Rahul Narwekar in 2021, when he was in the Opposition. The Marine Drive police which filed a case under sections of the Maharashtra Police Act sought condonation of the delay in filing a chargesheet after two years.
The second case was of a protest by Congress MLA Nana Patole in 2022, in which the police sought permission to file a chargesheet after one year.
“In the present matter, there is a delay of almost two years. The reason for that delay is stated as ‘Due to bandobast (security) of IPL matches, assembly bandobast and Honourable PM visit bandobast’. It is (a) very lame excuse to condone the delay of two years. The delay is not explained properly. Under such circumstances, application liable to be rejected,” the judicial magistrate first class, Girgaon said in the order on October 15, related to Narwekar.
A similar order was passed in the case against Patole.
