A special court on Thursday rejected an application filed by the CBI to conduct further probe in a case against actor Suraj Pancholi, who is facing trial for allegedly abetting actor Jiah Khan’s suicide in 2013. The court also rejected a similar application filed by Khan’s mother, Rabia.
Months after the trial against Pancholi began in 2019, the CBI had sought permission to send the dupatta allegedly used by Khan to hang herself to the Central Forensic Science Laboratory in Chandigarh for further examination.
It had also sought to retrieve the deleted messages exchanged between Khan and Pancholi through the BlackBerry Messenger by sending both their phones to the forensic unit of the Federal Bureau of Investigation in the US. The CBI had claimed that the chats between Khan and Pancholi just before her death are relevant for further investigation.
Pancholi’s lawyer Prashant Patil had opposed the plea stating that a similar plea filed by Rabia before the Bombay High Court in 2017 had been rejected. He had said that the plea sought examination of the dupatta and BBM messages in February 2017. He argued that there was no change in the circumstance for the CBI to change its stand, as it had opposed Rabia’s plea in HC. Patil had said that both applications were filed to delay the trial.
Jiah was found hanging in her Juhu home by her mother Rabia on June 3, 2013. Pancholi was arrested on June 10, 2013 and granted bail in July. He is facing trial on charges of abetment of suicide based on the chargesheet filed by the CBI. Rabia has opposed the CBI’s stand, stating that her daughter had not died by suicide.
