High Court refuses enhanced maintenance to ‘extremely wealthy’ wife

Given the woman's financial background, the Court said she created a facade that she has no income of her own.

The Bombay High Court refused to enhance maintenance to a woman observing that “both the husband and wife were extremely wealthy” and given the woman’s financial background, she created a facade that she has no income of her own.

A family court allowed couple to divorce in 2002, based on a petition filed by the husband which was later amended to allegations of cruelty. The south Mumbai couple got married in May 1993 and has a now daughter who is studying abroad.

The husband was directed to pay Rs 25,000 each to the wife and daughter. The woman then moved the HC seeking enhancement of maintenance.

The wife earlier claimed in court that she did not understand finances or the business and as she is not educated. “We do not believe that she (wife) is a person without means or capability. She has proceeded to educate her daughter in England without seeking the father’s consent… with the express knowledge about the costs of education abroad. She is no doubt a person of means…,” said Justices A S Oka and A K Menon.
