‘Followed SC order’: Narvekar rejects Shiv Sena UBT claims

Speaker Rahul Narwekar said that while deciding which was the real political party, he did follow three criterion set by Supreme Court which are constitution, organisational structure and legislative majority.

Maharashtra Assembly Speaker Rahul Narwekar on Tuesday said that the claims made by Shiv Sena (UBT) against his order on disqualification petition hold no ground as he relied on the only available constitution of the Sena with the Election Commission of India and that was from 1999.

Addressing a press conference after the allegations levelled against him by Uddhav Thackeray-led Sena that the order was biased, Narwekar said, “The Supreme Court had asked the Assembly Speaker to decide which was the original political party. While deciding this, constitution of the party was to be referred to and the court had directed to use the constitution that was submitted to the ECI before the emergence of rival factions.”

Narwekar said that he had written to the ECI on June 7, 2023, seeking submitted and recognised constitution of the Shiv Sena and the ECI replied on June 22, 2023, giving the copy of the party constitution of 1999. “I had even asked for an amended copy. But the the ECI replied saying the 2018 copy is not on record. When it is not on record, there is no question of giving a verdict based on it,” said Narwekar.

Narwekar said that while deciding which was the real political party, he did follow three criterion set by Supreme Court which are constitution, organisational structure and legislative majority.

The Speaker said that the letters displayed by Thackeray’s Sena are merely about informing the ECI regarding the organisational elections conducted in 2013 and 2018. “These letters nowhere mention about the submission of amended constitution. I was directed by the supreme court to rely only on the recognised constitution submitted to the ECI and I have done so,” said Narvekar.

When asked that he was present and voted in the 2013 meeting of the Shiv Sena when Uddhav Thackeray was elected the party president, Narwekar said that he does not know which video was shown by Thackeray’s Sena and it should be checked as to whether no doctored video was presented.
