Bombay High Court Wednesday observed that the state governments stand against police officers who arrested two college students from Palghar for posting comments on Facebook criticising the shutdown in the city after the death of Shiv Sena chief Bal Thackeray,was casual and convenient.
The courts remarks were preceded by the states submission that it would not take criminal action against the police officers while a departmental inquiry against them was pending. Additional public prosecutor Jayesh Yagnik said the state home department would not take criminal action against the officers at this stage. SP Thane (Rural) Ravindra Shengaonkar,Additional SP Thane (Rural) Sangram Nishandar and senior inspector Shrikant Pingle are facing inquiry.
The court was hearing a PIL by former journalist Ketan Tirodkar seeking action against the errant policemen for the alleged wrongful confinement of the two girls and fabrication of records.
A division bench of the Justice S C Dharmadhikari and S B Shukre said the government had earlier filed an affidavit that the officers were guilty of falsification of records. Now you dont want to take action against them. This is very convenient, the court said.
Justice Dharmadhikari said if someone is found infringing upon the freedom of a person and is held guilty,it would suffice for registration of a criminal offence. The court asked the state to make its submission in an affidavit in four weeks.
