Exceptional punctuality by jail SP in giving medical treatment to Avinash Bhosale: court

A SPECIAL court, while rejecting bail to Pune-based businessman Avinash Bhosale recently, said that while many accused in Arthur Road jail fell ill and do not get proper treatment in time, “exceptional punctuality” has been shown by the jail superintendent in admitting Bhosale to state-run hospitals when he had any medical issue.

The court made the observation while rejecting the bail plea of Bhosale, who was arrested by the Enforcement Directorate (ED) in connection with DHFL-Radius Group loan case.

“It is a fact that in Arthur Road Jail many accused persons fell ill, but they could not get treatment in proper time. They have to apply to the court. When the court directs with specific compliance, only then the other ill prisoners are taken to the hospital. However, regarding the applicant (Bhosale), exceptional punctuality has been shown by the jail superintendent,” special Judge MG Deshpande said in the order passed on July 20.

The court further said that whenever Bhosale made a complaint of any medical issue, the jail superintendent and medical officer “never wasted a minute” in admitting him to public hospitals “in a special room under the special team of doctors” and later simply forwarded the reports to the court regarding it.

“I am also constrained to note that, right from the beginning since he has been arrested by the ED, till date the maximum period the applicant has spent in the hospital and for a very short period he was in jail. Even today he is in St George Hospital,” the court said.

The court said that the medical papers indicate the doctors treating Bhosale have not communicated about any life-threatening sickness suffered by Bhosale. The court said that in these conditions it is clear that Bhosale has been receiving good treatment in the hospital and hence there is no ground to consider releasing him on bail based on his medical condition.

Earlier this year, the CBI which had also arrested Bhosale last year, had sought for the formation of a medical board to verify his medical condition. The court said that Bhosale’s treatment was not discontinued. The court also considered Bhosale’s role in the case stating that there was prima facie evidence of his in money-laundering of the loan received from Yes Bank to DHFL for the benefit of the co-accused.
