The sposal of cases registered under the Negotiable Instruments Act is on the rise following Bombay High Courts instructions to speed up the process. Alternative dispute redressal forums like the Lok-Adalat has also helped in the speedy disposal of the cases.
According to statistics provided by Bombay High Court Chief Justice Mohit Shah during the inauguration of the first mediation center at the esplanade court,67,058,cases were disposed off till November 10 this year as compared to 51,823 in 2008.
The figures are very good and if the cases are disposed off faster then automatically there will be a reduction in the institution (filing) of cases as people will be more satisfied, said Shah.
The Chief Justice also spoke on the need for mediation and said that in cases under Negotiable Instruments Act and Domestic Violence Act,it will be more effective as in foreign countries like US and UK. In the US,80 per cent of the cases filed are settle through mediation,Shah said.
According to Shah,mediation is more effective and should be used and practiced more often in Indian courts. Moreover,the population of judges/million people is very low in India and thus these forms of Appropriate Dispute Resolution (ADR) are needed.
Justice Shah also said among other ADR methods,mediation is more private and participation of complainant and accused is involved and thus it leaves them more satisfied.
