A special Prevention of Money Laundering Act (PMLA) court on Tuesday refused to grant bail to 78-year-old Kashinath Tapuriah,a Kolkata- based industrialist,who has been behind bars for nearly two years for his alleged involvement in a multi-crore money laundering case.
Tapuriah,who along with Pune-based stud farm owner Hasan Ali Khan,is an accused in the money-laundering case,had moved a bail application citing failing health as grounds for bail.
Tapuriah is suffering from multiple age related ailments. Heart ailments and brittle bones are serious concerns,which need to be addressed immediately, said his lawyer Tarun Sharma,who had moved the bail application in August last year.
The court,however,observed that no apparent reason is established to release him on bail.
Tapuriah,in his statement to the Enforcement Directorate had claimed that he is a director of 16 companies running from an address at Camac Street,Kolkata. His businesses include investment and trading,cable wire,steel,chemicals and cotton.
The ED,in its chargesheet,claimed that Tapuriah had advised Khan on his foreign bank accounts. Tapuriah is facing charges of conspiracy and several sections under the PMLA for his alleged involvement in laundering US $ 70,000.
While the investigating agency filed the chargesheet in May,2011,the trial is yet to commence.
It has taken over eight months for a court to dispose a bail application on health grounds. We will approach the High Court against this order, Sharma said.
Sharma,in the application,had cited as many as 13 different health complications. Tapuriah has been kept under medical care even inside the jail. Every day at least 20 medicines have to be administered to him, Sharma claimed.
