The Mumbai police registered an FIR against two people including a contractor on Thursday for allegedly causing death due to negligence after a labourer died and another sustained injuries while constructing Brihanmumbai Municipal Corporation quarters in Vikhroli.

An officer said that work was going on for the construction of BMC quarters behind the Runwal forest building on LBS Road in Vikhroli. Around 10.30 am on November 3, Mohammed Moazzam (27) and his colleague Saif Ali Hayat (23)—both from Bihar—were working in a pit on the site. Debris of soil and stones near the pit collapsed and Hayat was buried alive while Moazzam was injured.

The duo were rushed to a hospital, where Hayat was declared dead. His postmortem report mentioned that Hayat had died because of “polytrauma leading to shock”.

Moazzam is undergoing treatment at the Ashwini Hospital in Mulund, with injuries on the back of his head, chin and waist. The Parksite police recorded his statement.

The police found that the work of constructing a pillar of approximately two feet height was going on in a pit. “There was just a flimsy-looking net of green colour that had been carelessly placed to prevent the soil of the south side of the pit from falling on those working in the pit,” an officer said.

The police found that the contract for the work had been given to M/s Dev Engineers by the BMC’s construction department. Balveer Singh was appointed as project in-charge and Vijay Kumar Mishra as site supervisor by M/s Dev Engineers, which had assigned Kashinath Dasharath Hede of M/s Shree Balaji Enterprises a work order to complete the construction under his supervision.

“Senior site supervisor Vijaya Kumar Mishra and Kashinath Dasharath Hedde of M/s Shree Balaji Enterprises were given full responsibility at the work site, yet they disregarded the safety measures of the labourers working there. So an FIR has been registered against them,” said an officer from the Parksite police station.
