IN THE Malegaon 2008 blast case, the special court has ordered to attach the property of Ramchandra Kalsangra, a wanted accused. Kalsangra was named as one of the conspirators and the main accused in the blast which occurred in Malegaon on September 29, 2008. On Thursday, special judge A K Lahoti said that a warrant was previously issued against Kalsangra but he has remained absconding.
“The warrant could not be executed as the accused is absconding and concealing his presence. Thereafter, the order of issue of proclamation has been passed. Even after promulgation of proclamation the accused did not turn up before this court. Therefore, as per Section 83 the warrant of attachment is issued by this court to attach the property of absconding accused Ramchandra Gopalsingh Kalsangra,” the special court said.
Seven accused are currently facing trial in the blast case and the National Investigation Agency (NIA) has named Kalsangra and Sandeep Dange as accused. While a warrant was issued against Dange too, the agency had submitted that there was no known property belonging to him and hence an attachment warrant was not sought. The agency had claimed that the property ordered to be attached belonging to Kalsangra is in Madhya Pradesh. The agency claims that the bomb was planted on an LML Freedom scooter by Kalsangra and Dange had accompanied him. The two were never arrested in the case.
The court is currently recording the statements of the accused as per Section 313 of the Criminal Procedure Code.
