A three-judge bench of the Allahabad High Court on Friday held that a candidate seeking appointment as an assistant teacher in a primary school (for Class 1 to 5) will have to qualify the Teachers Eligibility Test (TET),as per norms prescribed by the National Council for Teacher Education (NCTE) through its notification on August 23,2010.
The three-judge bench,comprising Justices Sunil Ambwani,Amreshwar Pratap Sahi and P K S Baghel,said that TET was an essential and additional norm and not a minimum qualification for being eligible for the job of primary teachers.
It is correct that eligibility means the minimum criteria for selection but in the instant case,TET is not a minimum criteria fixed for selection. It is an essential integral part,other than the education and training qualification prescribed,to be possessed by a candidate before he is appointed as a teacher, the court said.
The court left open for further debate the cases of those candidates who were appointed after the August 23,2010,notification on the basis of old norms,but have not qualified through TET. The court noted the state governments submission on the issue was that it should be treated as a closed chapter.
