Trinamool worker’s death: SC junks plea against CBI probe

The Supreme Court Monday dismissed the West Bengal government’s plea to quash the Calcutta High Court order to hand over the probe into the death of a Trinamool Congress worker to the CBI.

“We are not inclined to entertain it,” said a Bench of Justices A K Patnaik and Ranjan Gogoi. The vacation Bench had last week agreed for an early hearing of the appeal.

The HC had last month directed the CBI to inquire into the alleged custodial death of Kazi Nasiruddin at Dhaniakhali in Hooghly in January. Nasiruddin died allegedly due to police excesses after he was picked up for not possessing the required documents of his vehicle.

While the state government had handed over the case to the CID,a PIL was moved in the HC for a CBI inquiry.

In the plea to SC,the state government had also contested the strictures passed by the HC against the CID probe and contended that there was nothing on record to substantiate the allegations of an improper probe. The HC had listed a clutch of queries that were not addressed by the CID probe.

It was alleged that Nasiruddin’s death was a pre-planned murder since he was on the verge of quitting the Trinamool Congress. After he was picked up on January 18, one of his friends was allegedly called to the police station in the late hours and was asked to take him to hospital claiming that he was not well. On being taken to a government hospital,the doctors declared Nasiruddin brought dead.

The state government had handed over the investigation into Nasiruddin’s death to CID following a furore over the death.

A PIL was then filed by an advocate praying for a CBI investigation claiming that a fair and impartial investigation was not possible by any state agency as the allegation was against the state police.

The High Court,upon hearing the submissions of the petitioner and the state,had criticised the pace and manner of the investigation.
