‘Premeditated; DNA evidence links survivor, main accused’: What chargesheet in Kolkata law college rape case says

The Kolkata police submitted the chargesheet in the law college rape case on August 23, nearly two months after the alleged incident took place on June 25.

The Kolkata Police’s chargesheet in the alleged rape at a law college in the city has stated that forensic reports have corroborated the allegations made by the survivor, a student in her 20s, and confirmed the involvement of the main accused, Monojit Mishra. The chargesheet adds that the alleged rape was premeditated.

According to the chargesheet, a copy of which is with The Indian Express, the DNA results from the bodily fluids found on the survivor’s clothes matched Mishra’s blood sample. “Medico-legal exhibits, along with other exhibits, were sent to the State Forensic Science Laboratory, Belgachia, Kolkata, for examination. Reports received corroborated the victim’s allegations,” the chargesheet further stated.

The police had submitted the chargesheet before the court on August 23, nearly two months after the alleged rape took place on June 25. Apart from Mishra, a former TMC students’ wing functionary hired by the college on a contractual basis, security guard Pinaki Banerjee, and students Zaib Ahmed and Pramit Mukherjee have been arrested in the case.

According to the chargesheet, forensic reports, including video clippings found from the mobiles of three accused, allegedly reveal that it was Mishra who raped the student. “Several video clippings were found on the mobile phones of all three accused persons, and from the speech and physical appearance in those videos, it is clear that accused Monojit Mishra forcibly committed rape upon the victim,” the chargesheet stated.

Stating that witnesses’ statements “establish the influential character” of Mishra within the college, the police alleged in the chargesheet that the survivor had rejected Mishra’s marriage proposal. The accused “conspired to sexually exploit” the student, the chargesheet stated, adding that while Mishra allegedly restrained her, Ahmed instructed the guard to lock the main gate, and later, along with Mukherjee, locked the room from outside. “This establishes that the accused persons had a definite plan,” the chargesheet stated.

The police also alleged in the chargesheet that certain actions of the accused showed their calculated conduct.

The survivor, who had recorded her statement under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, appeared for exams in July. She recently sought a transfer from the college. According to university sources, the matter is being looked into.
