Forensic report arrives,DNA of one accused matches in Kamduni case

Charge of gangrape to be slapped on all other accused also,report to be produced in court Monday

The CID Saturday received the forensic report from the Hyderabad’s Central Forensic Science Laboratory (CFSL) in the Kamduni rape-murder case — almost a month after the agency filed the chargesheet without the forensic report.

The forensic report,which includes the DNA tests of both the victim and the accused,is said to have stated that the 20-year-old victim was raped by one person and that the DNA profile of one of the accused,Saiful Ali,has matched with the evidence collected from the crime scene .

The report would be submitted in court on Monday.

ADG,CID,Shibaji Ghosh told The Sunday Express,“We have received the report today. It is a content-heavy report. The DNA test has revealed that the victim was tortured and raped by one person; samples sent for tests in the case matches with Saiful Ali’s DNA.”

When asked if the rape charge will be pressed against other accused,Ghosh explained: “All arrested are accused in the gangrape case. The rape was committed by Saiful as the DNA report claims but other accused assisted him in the crime,which is why the charge of rape is slapped on all of them.”

The accused have been charged under Section 376D of the Indian Penal Code (IPC) in the chargesheet that was submitted to the court by the CID.

Under the Criminal Law (Amendment) Act,2013,Section 376D of the IPC is explained as “where a woman is raped by one or more persons constituting a group or acting in furtherance of a common intention,each of those persons shall be deemed to have committed the offence of rape and shall be punished with rigorous imprisonment for a term which shall not be less than twenty years,but which may extend to life which shall mean imprisonment for the remainder of that person’s natural life.”

Assistant Public Prosecuter in Barasat court Shantamoy Basu,too,confirmed that the sections of gangrape are applicable on all accused. “I have got the information that the CID has received the forensic report. And the report will be submitted to the court on Monday.”

Meanwhile,four days ago,two of the accused in the Kamduni case — Saiful Ali and Gopal Naskar — moved the third fast-track court in Barasat. On Monday,the duo moved the court seeking a withdrawal of the “confessional statements” made by them before a magistrate. The duo submitted they had made the statements after being tutored by CID officers. The court put off the hearing till August 23.
