The Delhi High court on Thursday asked the Delhi government to file an affidavit, offering an explanation for its decision to dissolve and supersede the Delhi Wakf Board instead of holding elections for the vacant posts.
The query was posed by the bench of Justice R S Endlaw, in response to a plea filed by ousted Wakf Board chairperson Rana Parveen Siddiqui and member Mohammad Qasim, who had challenged the decision taken by the Delhi government on October 8 .
The counsel for Siddiqui argued that the Delhi government could not have dissolved the board, as the two remaining members still had tenure. The petitioners have claimed that elections to the vacant posts should have been held and the work of the board was stalled by the government decision.

Senior advocate H S Phoolka, appearing on behalf of the government, argued that five of the seven board members had resigned, making the board incapable of taking any decisions. The board consists of four elected members and three members nominated by the government.
Phoolka also told the bench that the vacancies “will be filled up” soon and the supersession “will not remain,” as it was the government’s prerogative to conduct elections and nominate members to the board.
Meanwhile, the counsel for Lieutenant Governor Najeeb Jung informed the high court bench on Thursday that the decision did not have the approval of the LG.
