He has been settling court cases arguing on behalf of the Delhi government for nearly 15 years. But Tihar jails law officer Sunil Guptas own legal battle with the government for better pay just keeps dragging on.
The state has moved the Supreme Court against a High Court order of last November asking it to increase Guptas pay by two scales. In its order in November last year,the High Court asked the government to create promotional avenues for Gupta,as per Chief Secretarys recommendations of 2008,and upgrade his pay band to give incentives and boost morale.
Noting Gupta had been meted out unfair treatment,the division bench headed by Acting Chief Justice A K Sikri gave the government two months to upgrade his payscale by two notches.
But during a recent High Court hearing on a review of a contempt petition filed by Gupta,the government disclosed it had challenged that order in the Supreme Court.
In his review petition,Gupta argued the government must be hauled up for willful non-compliance of the division benchs order since it had missed the deadline the court had set.
In the first hearing of the contempt petition,Justice Vipin Sanghi gave the government three weeks time to comply with the division benchs verdict.
Guptas counsel Sanjiv Sharma moved a review application of this order and argued no more extension could have been given by this single-judge bench when the division bench had declined to allow any more time.
While Justice Sanghi turned down the request to review his previous order by holding that it was passed in the presence of Guptas counsel.
Justice Sanghi,however,refrained from passing any orders on Gupta’s plea and disposed of the review application.
