Tihar law officer’s fight for better pay drags on

Noting Gupta had been meted out “unfair treatment”,the division bench headed by Acting Chief Justice A K Sikri gave the government two months to upgrade his payscale by two notches.

But during a recent High Court hearing on a review of a contempt petition filed by Gupta,the government disclosed it had challenged that order in the Supreme Court.

In his review petition,Gupta argued the government must be hauled up for “willful” non-compliance of the division bench’s order since it had missed the deadline the court had set.

In the first hearing of the contempt petition,Justice Vipin Sanghi gave the government three weeks’ time to comply with the division bench’s verdict.

Gupta’s counsel Sanjiv Sharma moved a “review” application of this order and argued no more extension could have been given by this single-judge bench when the division bench had declined to allow any more time.

While Justice Sanghi turned down the request to review his previous order by holding that it was passed in the presence of Gupta’s counsel.

Justice Sanghi,however,refrained from passing any orders on Gupta’s plea and disposed of the review application.
