The parents of a 25-year-old man,crushed to death by truck in 2011,have been awarded Rs 28.05 lakh as compensation by accident claims tribunal. The Motor Accident Claims Tribunal (MACT) has asked the Cholamandalam General Insurance Company Ltd,which had insured the offending vehicle,to pay the amount to the parents of Rajnish Ranjan,who had died in the accident on May 8,2011.
Ranjans parents,Bihar residents Sunila Devi and Jai shankar Prasad,had filed a claim of Rs 50,000 against the errant driver and the owner of the truck,stating that their son,an executive at DLF Gurgaon,was driving home on his motorcycle when the truck had hit him. The MACT court accepted their claim of death caused by negligence.
The court calculated the compensation based on the salary drawn by the deceased,and the fact that the claimants did not need to prove the guilt of the driver beyond reasonable doubt.
The guilt of the driver being established,the insurance company that had insured the truck was directed to pay the compensation amount.
The insurance company has not proved any defence available to it under statute. Therefore,the compensation should be deposited by the insurance company within 30 days, the tribunal said.
