Jahangirpuri violence: Year on, no trial yet; 44 persons arrested, all but one out on bail

Eight police personnel and a civilian were injured in the violence that broke out on April 16, 2022. While all, except one person, have been granted bail, another remains absconding.

A year since violence broke out in Northwest Delhi’s Jahangirpuri during a ‘Shobha Yatra’ on the occasion of Hanuman Jayanti, the Delhi Police has arrested 44 persons and apprehended two juveniles in connection with the violence, and filed at least six chargesheets, including five supplementary chargesheets.

Eight police personnel and a civilian were injured in the violence that broke out on April 16, 2022. While all, except one person, have been granted bail, another remains absconding.

“All the 44 accused have been granted bail while one person, Jahangir, a vagabond, remains absconding… we arrested an accused, identified as Salman alias Suleiman, 24, who was in hiding in West Bengal and Mumbai, in February this year and he still remains in jail,” said an officer. The officer added that the two juveniles were released by an observation home a few months after the incident. Separate investigation reports regarding the case for both juveniles were filed before the observation home.

While the main 2,063-page chargesheet was filed in Rohini court on July 14 last year by the Delhi Police Crime Branch, at least five more supplementary chargesheets were filed by the police before court in the subsequent months. The cognisance of the main chargesheet was taken on July 28. “The matter is yet to go to trial and the case is at the stage of framing of charges,” said the officer.

Police had booked the accused persons under IPC section 307 (attempt to murder), section 120B (criminal conspiracy), section 186 (voluntarily obstructing any public servant in the discharge of his duty), section 147 (punishment for rioting), section 34 (acts done by several persons in furtherance of common intention), among other sections.

The chargesheet, which had claimed that the communal clashes in the area were an “extension” of the anti-CAA and anti-NRC protests in 2019 at Shaheen Bagh and Northeast Delhi riots in February 2020, named three persons — Md Ansar (35), and his associates Tabrez Khan (36) and Ishrafil (45) – as the “key conspirators” and members of WhatsApp groups where they allegedly mobilised people for anti-CAA protests and shared videos and news reports on riots and communal clashes.

Police, in the chargesheet, had stated that the accused were “clearly sharing objectionable and provocative contents to spread hatred and motivate fanatic/like-minded persons to prepare them to give effect to the conspiracy hatched by them”. Police had also stated that the accused persons had allegedly stocked up swords and pistols inside their houses in order to use them during the violence.
