Gurgaon RERA fines project developer over ‘misleading’ advertisement

The authority has taken a suo motu action in the matter, terming the advertisement "completely misleading". The promoter has not mentioned the registration details and the website address, as required, as per the regulations.

The Gurgaon Real Estate Regulatory Authority (RERA) has imposed a penalty of Rs 25 lakh on a developer for allegedly publishing a misleading advertisement of a real estate project in a mainstream daily, said officials.

The real estate watchdog came down on the promoter company — M/s Yashvi Homes Private Limited — against the advertisement of the residential project ‘Golden Gate Residency’ in Farukhnagar Sector 3. While the project comes under the policy Deen Dayal Jan Awas Yojana (DDJAY), 2016, the advertisement published in the newspaper captioned it as DDJAY 2024, “which is incorrect and misleading”, observed the authority.

According to the provisions of Section 11(2) of the Act, advertisement of prospectus issued or published by a promoter shall prominently mention website address of the authority, wherein details of the registered project were entered, including the registration number obtained from the authority and other such matter incidental to it, said the authority.

“While there is no provision for amenities such as school, clubhouse, swimming pool, badminton court, and half-basketball court among others in the approved layout plan, submitted by the promoter at the time of registration, the same has been mentioned in the advertisement,” said the authority’s spokesperson, adding that the amenities promised in the advertisement are not as per the sanctioned layout plan of the project.

The spokesperson also told The Indian Express that the advertisement had appeared in January 2024, adding that the builder had used “flowery language” to lure buyers and the advertisement did not meet any provision of the policy.

Under the provisions of Section 13(1) of the Act 2016, no promoter shall accept an amount more than 10 per cent cost of an apartment, plot or building.
