Delhi court rebukes cop for ‘filing false report to mislead’ in shooting case

The court noted that although the police alleged the accused fired a bullet outside the complainant's house, no bullet shells were found at the scene.

A Delhi court Friday censured a Delhi Police officer for “filing a false report” and “misleading the court” during the bail proceeding an accused in a firing incident earlier this month in Northeast Delhi’s Dayalpur.

In his order, Additional Chief Judicial Magistrate Tushar Gupta of Karkardooma courts, noted that while the police claimed that the accused, Mustakeem, fired a bullet outside the house of the complainant in the case, no bullet shells were recovered from the spot.

“In his reply, investigating officer (IO) has submitted that the accused Mustakeem was arrested by him on an information received from the secret informer, however after perusing the CCTV footage of the police station it can be seen that accused himself went to the police station and the same fact is confirmed by the IO on a query asked by this court,” the court said.

“Thus, it can be very well said that the IO filed a false report in this matter to mislead the court,” it added.

The accused claimed that a false FIR was filed against him, despite his family’s being the victims of an attack by a group that included the complainant.

“…this court deems it fit to issue notice to the Joint Commissioner of Police to take appropriate action against the IO for filing a false police report…and not investigating the case properly…action should also be taken against the SHO and ACP concerned for the supervisory lapses on their part,” the court said.

The accused, who spent 20 days in custody, also moved for bail, which the court denied.

“This court would have granted bail to the accused in the present matter had the IO failed to show the video of the accused who can be seen running with the katta in his hand,” ACJM Gupta said.
