Delhi court grants Supertech chairman 30-day interim bail on medical grounds

A Delhi court Tuesday granted real estate tycoon and Supertech chairman RK Arora interim bail for a month on medical grounds. Additional Sessions Judge Devender Kumar Jangala further directed the accused to furnish bail bonds worth Rs 1 lakh.

Arora was arrested in June last year by the Enforcement Directorate (ED) based on 26 FIRs registered by the Economic Offences Wing (EOW), Delhi Police, Haryana Police and UP Police against Supertech.

According to the FIRs, Supertech allegedly cheated at least 670 homebuyers of Rs 164 crore. The main allegation put forth by the homebuyers was a delay in handing over possession of flats.

The ED further alleged that money collected by Supertech was siphoned off from ongoing projects through various shell companies. The agency stated that a prima facie case under sections of the Prevention of Money Laundering Act (PMLA) is made out against the accused.

Arora had sought interim bail for 90 days, stating that his diagnosed disc degenerative disease was showing no improvement despite two months of treatment. He further cited his 10 kg weight loss and acute depression – medication for which was causing various side effects such as hallucinations and withdrawals.

It was also submitted that medical facilities in government hospitals were inadequate compared to private hospitals and that the accused had a right to choose private treatment at his expense.

The bail plea was, however, opposed by the ED, which stated that the medical condition of the accused could be treated by jail authorities themselves and that there was no urgent requirement for releasing Arora on bail.

It was also argued by the agency that the accused committed the crime with the alleged ailment and, therefore, if he could commit the crime with the ailment, he was also capable of suffering incarceration.
While granting the accused bail, the court held that a super specialty hospital had prescribed Arora surgery which makes the present case one of ‘exceptional circumstances’ wherein specialised surgery is required for treatment of the ailment.

ASJ Jangala further noted that the case was currently at the stage of scrutiny of documents and the release of the accused would in no way hamper the investigation or the trial.
