A Delhi court has held that a complaint filed against Delhi Chief Minister Sheila Dikshit,PWD Minister Raj Kumar Chauhan and former Commonwealth Games Organising Committee chairman Suresh Kalmadi for alleged corruption in CWG-related projects was maintainable.
It pulled up the Delhi Police for failing to take action in the matter.
The court of Additional Chief Metropolitan Magistrate Manish Yaduvanshi issued notice to the DCP and Additional DCP of the Economic Offences Wing,noting there was deliberate attempt and unnecessary delay in filing a reply to queries by the court.
The DCP and Additional DCP have been summoned on September 26 with proper reports as sought by the court on the complaint filed by RTI activist Vivek Garg.
In his complaint,Garg alleged that there was large-scale corruption during the Commonwealth Games. The complaint said the accused conspired and allowed huge escalation in costs of construction of Games stadia,causing waste of public money.
He said police failed to register an FIR against the CM and others.
In December 2011,the court asked police to furnish a query-wise reply on whether the complaint disclosed any cognisable offence and what action has been taken on it.
In a status report,police said: As matters related to CWG are already being investigated by CBI,all complaints have been sent to CBI.
The court had also raised the question of why the complaint had been transferred to the CBI when the state police had no power to transfer cases to the agency without official sanction.
Speaking to Newsline after the court proceedings,Garg said the court order implied that the EOW would now have to register an FIR against the CM and the others or would be ordered to do so on the next date of hearing.
Responding to the courts observations,PWD Minister Raj Kumar Chauhan said the Shunglu Committee and the CBI had given a clean chit to the government in the matter and that the government is ready for any probe.

The Chief Minister must resign to ensure a fair probe into the allegations. She has lost the moral right to remain Chief Minister of Delhi after the court order, Delhi BJP president Vijender Gupta said. He also demanded immediate filing of FIRs against those involved in graft in Commonwealth Games projects.
