From The Courts: 20-yr-old convicted for raping minor,gets 10-year RI

A city court highlighted the “criminal apathy” of the public towards crimes against women,as it sentenced a 20-year-old man to rigorous imprisonment for 10 years for raping and threatening a 14-year-old girl from his neighbourhood.

A city court highlighted the “criminal apathy” of the public towards crimes against women,as it sentenced a 20-year-old man to rigorous imprisonment for 10 years for raping and threatening a 14-year-old girl from his neighbourhood.

Court was told that on October 20,2011,Aditya had forced the girl into a plastic factory in their neighbourhood while she was returning home from school. He tried to strangulate her when she resisted and threatened to electrocute her if she continued to resist and raped her.

Additional Sessions Judge Kamini Lau also took note of the fact that two factory workers — Ram Sewak and Shiv Shankar — were present in the factory at the time,but instead of helping the girl or raising the alarm,they ran out of the factory when Aditya threatened them.

“No explanation is forthcoming for this kind of an indifferent and unconcerned approach of these workers,as well as that of the investigating agency that has not even bothered to inquire into the same and book the men under appropriate legal provisions,” Lau said.

The court said: “It is this kind of public apathy and indifference which is grossly criminal.”

The ASJ also imposed a fine of Rs 52,000 on Aditya. Of this,Rs 50,000 is to be paid to the victim as compensation.

The court also ordered the Delhi government to pay the girl Rs 1 lakh as compensation and to ensure that the girl continues her studies in another school.

The girl was a student of Class IX at the time of the incident and Aditya studied in the same school. She had left the school after she was raped.

Observing that the convict had “without any fear of law in broad daylight committed the offence in a factory after threatening two workers working there and compelling them to leave,” the court said the only mitigating factor was the convict’s young age,but declined to award a lenient sentence.
