US visit: Sukhmani moves High Court,seeks release of her passport

Faced with the difficulty of not having a property in Chandigarh which is free of encumbrances,a precondition for her to visit abroad,Sukhmani Brar has moved the Punjab and Haryana High Court seeking modification into its orders.

Faced with the difficulty of not having a property in Chandigarh which is free of encumbrances,a precondition for her to visit abroad,Sukhmani Brar has moved the Punjab and Haryana High Court seeking modification into its orders.

Brar had moved the High Court for release of her passport that was confiscated by the Chandigarh Police after she — in an inebriated condition — had crushed two children to death in August,2010. Earlier,the same request was turned down by a lower court of Chandigarh.

Brar had told the Court that she is a green card holder in the US,and the deadline to renew the membership was about to lapse. Thus,she should be allowed to visit the US.

On December 22,in a rare direction,Justice Jaswant Singh of the High Court had imposed heavy conditions to permit Brar to visit the United States. One such condition was to submit documents of a property registered in the name of Brar’s father or guardian in Chandigarh.

According to rules,a property which has to be submitted as surety should be free of all encumbrances. Brar has moved the High Court stating that since a property located in Chandigarh in the name of her guardian is under mortgage,she should be allowed to deposit the documents of a property in Mohali. The application is slated to come up for hearing on Monday.

Justice Singh had also made it clear that Brar must return to

India by January 31,failing which,the property will be confiscated by the Chandigarh administration.

In her fresh application,Brar has stated that she will take only a week’s time to complete the formalities regarding renewal of her citizenship of the US. She did not seek extension in the deadline.

She was also directed to deposit a fixed deposit receipt (FDR) of Rs 20 lakh. In case she fails to return within the stipulated time,the FDR shall be handed over to the parents of the deceased. The Court had also ordered that two heavy sureties will also have to be submitted before a local court of Chandigarh.

Earlier,the Chandigarh Police had strongly opposed Brar’s appeal before the local court.

It had submitted that there was a strong apprehension that Brar will flee if she is allowed to go abroad.

Following this,the lower court had dismissed her application. Making sure that Brar returns within the deadline,the High Court had imposed heavy conditions on her.
