Society runs primary school on nursery centre plot

The court issued notices to the DGSE,the Haryana Urban Development Authority and the Ajay Memorial Education Society,Panchkula in this regard.

The Punjab and Haryana High Court on Monday questioned the decision of the director general of school education (DGSE) in Haryana to allow a Panchkula-based educational society to run a primary school on a plot allotted for nursery institutions.

The court issued notices to the DGSE,the Haryana Urban Development Authority (HUDA) and the Ajay Memorial Education Society,Panchkula in this regard.

The notices were issued on a petition filed by Vijay Pal Singh and 28 other residents of Sector-7 Panchkula. The petitioners have challenged the order,dated Jan 11th,2013,issued by Haryana DGSE permitting Ajay Memorial Education Society to run a Primary School named Tulips World School in Sector-7,Panchkula.

Arguing on behalf of the petitioners,advocate H C Arora on Monday contended that the concerned residents had earlier also filed a PIL in the High Court seeking a direction to authorities,restraining them from allowing the Society to run a primary on land allotted for a nursery school by the Estate Officer,HUDA,in 1988.

The High Court had on December 16,2011,disposed of the petition by directing the competent authority to take a decision on whether the Society should be permitted to run a Primary School. The court also ordered the competent authority to take into consideration various relevant factors,including whether the running of a primary school would cause inconvenience to the residents of the locality.

The petitioners stated that they had also submitted a representation to the Haryana DGSE detailing that the HUDA had not permitted the society to run a primary school on the site. The petitioners had also submitted in their representation that the running of a primary school would lead to increase in traffic and hence cause environmental and noise pollution.

In court on Monday,they claimed that the Haryana DGSE ignored their contentions and allowed the Panchkula Society to run a school up to Class V. Issuing notices to the DGSE and other parties,the High Court also has asked the Director to explain as to why his order be not stayed.
