Finding little force in Chandigarh Administrations claim that it needs to verify if Rs 14,200 should be given per month to Sharmilas two children,the Punjab and Haryana High Court on Tuesday directed the Administration to deposit the amount in their bank accounts without further delay.
The high court also made it clear on Tuesday that the monthly compensation of Rs 14,200 can be modified if either of the parties (children or Administration) approaches the court. In response to a clarification sought by the Administration,the high court made it clear that Administration would continue to pay the compensation to the duo till they
are 21. Sharmilas two sons are 13 and 14.
As an immediate relief,as directed by the high court in the last hearing,the Haryana government and Chandigarh Administration have paid a compensation of Rs 1 lakh each to both the children. The high court was informed about this on Tuesday.
During the resumed hearing of a petition arising of a suo motu notice taken by the high court,Advocate Onkar Singh Batalvi,amicus curiae in the case,opposed the stand taken by the Administration in delaying the payment of the monthly compensation to the two children. In the last hearing,in September,the high court had ordered that an amount of Rs 14,200 be deposited each month.
Batalvi argued that since the Administration has not even filed an application to contest the direction,it is deemed to have been accepted. Finding force in his argument,the high court directed the Administration to start paying the same.
Sharmila Sharma,33,died allegedly due to negligence of the Chandigarh Police which caused delay in taking her to the hospital. She was hit by a CTU bus on May 7. Her husband had also died a similar death in October 2012. Duing the time,Sharmila was fighting for her husbands death as she had alleged that the Haryana Police caused delay in rushing her husband to the hospital.
