The SAS Nagar Consumer Disputes Redressal Forum has imposed a fine of Rs 1.5 lakh on a local construction company for not repairing the defects in a flat sold in 2011. Progressive Promoters has also been held deficient in services by the forum.

Gajendra Verma now a resident at one of the township of the Progressive Promoters at Zirakpur had purchased the flat in March 2011. Five months later and after paperwork when he was handed over the flat,he found that work in the flat was still incomplete. He complained that the facilities promised in the brochure and allotment letter have not been provided till date. The facilities included some basic ones such as TV and telephone sockets and improper finishing of interior work in washrooms and kitchens with others complaints about missing club house,swimming pool,jogging park etc.

However,Progressive Promoters denied the allegations and maintained that Verma was not entitled to any compensation as he was not a consumer because he had purchased the flat from open market from one Vinay Dua. Rejecting the contention,the forum ruled that being a subsequent purchaser of the flat in question,with his name duly entered in to the firms record,Verma is a consumer.

The forum also found that Progressive Promoters had been changing its stand in various documents. Different facilities were promised in the brochure while in the allotment letter some other set of facilities and specifications had been mentioned and making things worse,the sale deed mentioned some different set of specifications. This is an act of unfair trade practices,ruled the forum.

With the complainant producing photographic

evidence about the defects and deficiencies in the flat which remained unattended by the firm,the forum ordered it to pay the compensation with a month.
