Dismissing a complaint as frivolous,the UT Consumer Dispute Redressal Forum has directed a Panchkula resident to pay Rs 10,000 as penalty to Pearl Academy of Fashion,Jaipur,for causing harassment.
In her complaint,Neha Bansal stated that she deposited Rs 3.33 lakh as admission fee with the Pearl Academy and later paid Rs 51,500.
However,she could not continue her studies and left the institute in September 2008. She was refunded Rs 1.70 lakh.
Thereafter,the complainant visited the academy in Jaipur a number of times and also served a legal notice in July 2009 asking that the balance amount be refunded but in vain. Later,she moved the consumer forum.
In its reply,the Pearl Academy stated that the refund,which the complainant accepted without raising any objection,was given as per their policy.
Dismissing the complaint,the forum stated: The complainant has not mentioned the date on which she joined the course and for how many days she attended classes. Rather,she gave the impression that she had not attended classes at all. But the true facts came to light when the academy filed its reply stating that she had attended classes for almost a year.
It is clear that the academy has already refunded the amount entitled to the complainant and she has no claim on the remaining amount. There was no deficiency in service on their part as the complainant chose to leave the course midway due to unavoidable circumstances, stated the order.
